Legal information

The Declaration of Performance should be the only document required at the stage of admitting the product for purchase or final acceptance of the product.

“According to Article 10a of the Act on Construction Products, which deals with the requirements of the national system of assessment and verification of performance, the manufacturer of a product is not obliged to transfer the National Technical Assessment (NTA) to the buyer, which means that the buyer has no right to effectively demand that such documents be delivered to him. The only document that goes with the purchased construction product is the Declaration of Performance (DoP), which confirms the validity and compliance of the purchased product with the requirements included in the NTA.” (Written opinion of the Main Construction Supervision Office Warsaw 20 November 2019)

The approval document for products such as: refuge island, speed bump and speed hump, traffic separator is the National Technical Assessment (NTA), on the basis of which the manufacturer issues a Declaration of Performance (DoP). Products in group number 12: Road safety equipment – road equipment include: Traffic Noise Reducing Devices / Assemblies, Headlight Glare Screen Panels, Speed humps, Traffic Separators, Refuge islands, Blocking Posts, Road Mirrors and Safety Guards. The NATIONAL SYSTEM OF ASSESSMENT AND VERIFICATION OF CONSTANCY OF PERFORMANCE used in this group is number 3 (Warsaw, 6 December 2016. Item 1966 REGULATION OF THE MINISTER OF INFRASTRUCTURE AND CONSTRUCTION) of 17 November 2016 on the method of declaring the properties of construction products and the method of marking them with a construction mark).

It is good practice for our company to add the vat invoice number and date of issue to the copy of the DoP, in order to confirm thereby that on the date of sale the products had a current NTA.
